  1. OBJECT

The Keolis TRAM Santa Azur Company has chosen to publish, animate and make available the website www.santa-azur.com (hereinafter the “Site”), the main purpose of which is to communicate information on the subsidiary of the Keolis TRAM Santa Azur Group, its activities and news.

The purpose of these general conditions of use (hereinafter the “CGU”) is to define the conditions under which users are authorized to connect to the Site. Any access to the Site automatically entails the application of the CGU, the user is deemed to have read and accepted the CGU without reservation when consulting the Site.

The applicable CGU are those in force on the date of each user connection to the Site. It is specified that the Keolis TRAM Santa Azur Company remains free, at any time, to enrich, modify, correct or delete all or part of the CGU. These modifications will be considered as having been brought to the attention of users by the simple fact of their posting online. Therefore, they are deemed to be accepted without reservation by any user accessing the Site after they have been put online. In any case, the responsibility of Keolis TRAM Santa Azur cannot be limited and/or excluded in the event of physical injury, gross negligence or wilful misconduct.

  1. FORCE MAJEURE

Any event due to a case of force majeure, within the meaning of article 1218 of the Civil Code and the jurisprudence of the courts and tribunals, resulting in particular in a malfunction of the Internet network or the server does not engage the responsibility of the Keolis TRAM Santa Azur Company.

7. APPLICABLE LAW

Any dispute in connection with the use of this Site is subject to French law.

These GCU are subject to French law.

They are drawn up in French, notwithstanding any translation that may be made of them elsewhere. In any case, the French version of the GCU shall prevail over any other foreign language version.

In the event of a dispute relating to the validity, interpretation or execution of the GCU, the Society Keolis TRAM Santa Azur and the user agree to meet and try to find an amicable solution to their dispute within sixty (60) calendar days. In the event of failure to find an amicable solution, any dispute relating to the interpretation, validity and/or performance of the GCU shall be submitted to the competent courts, including in the event of multiple defendants or third party proceedings, for procedures aimed at obtaining emergency or protective measures, in summary proceedings or on request.
